Return and Refund Policy

1. General Policy: No Returns or Refunds

We aim to ensure customer satisfaction with our true-to-size apparel. However, to maintain low prices and operational efficiency, all sales are final, and we do not accept returns or issue refunds except as required by law for defective or incorrect items (see Section 2). This includes, but is not limited to, returns due to:


  • Change of mind or buyer’s remorse.


  • Sizing issues (our shirts are true to size based on standard U.S. sizing charts, available on the Website).


  • Dissatisfaction with color, style, or fit.


We encourage you to review product descriptions, sizing charts, and care instructions carefully before purchasing to ensure the item meets your needs. 

2. Exceptions for Defective or Incorrect Items

In accordance with Michigan’s Consumer Protection Act (MCL 445.901 et seq.) and Michigan’s Uniform Commercial Code (MCL 440.2101 et seq.), we provide remedies for defective or incorrect items as follows:


2.1. Defective Items: If an item is defective upon receipt (e.g., damaged, faulty stitching, or material defects), you may request a replacement, refund, or store credit, at our discretion.
2.2. Incorrect Items: If we ship an item that does not match your order (e.g., wrong size, color, or product), you may request a replacement, refund, or store credit, at our discretion.
2.3. Process:  


  • Contact Us: Email usa@happybirthdayamerica.com within 7 days of delivery with your order number, a description of the issue, and photos of the defective or incorrect item.  


  • Return Shipping: We will provide a prepaid return shipping label for defective or incorrect items. If you initiate a return without our approval or outside the 7-day window, you are responsible for return shipping costs.  


  • Inspection: Upon receipt, we will inspect the item to confirm the defect or error. If verified, we will process a replacement, refund to your original payment method, or store credit within 7-10 business days.  


  • Non-Eligible Items: Items damaged due to improper care, misuse, or failure to follow care instructions are not eligible for return or refund.


2.4. Statutory Rights: Nothing in this policy limits your rights under Michigan law, including remedies for non-conforming goods, or federal consumer protection laws enforced by the Federal Trade Commission (FTC). 

3. Non-Returnable Items

The following items are not eligible for return or refund, except as required by law for defects or errors:


  • Custom or personalized orders.


  • Clearance or sale items marked as final sale.


  • Items purchased from third-party retailers (not directly from happybirthdayamerica.com).

4. Shipping-Related Issues

4.1. Lost or Damaged Shipments: If your order is lost or damaged during shipping, contact us at usa@happybirthdayamerica.com within 7 days of the expected delivery date (5 business days for in-stock items, 30 days for backordered items). We will work with the carrier to resolve the issue, which may include a replacement or refund, subject to our discretion and carrier policies.


4.2. Delayed Shipments: As stated in our Terms and Services, delivery timelines (5 business days for in-stock items, 30 days for backordered items) are estimates and subject to change due to market availability or unforeseen circumstances (e.g., weather, supply chain disruptions). If delays exceed 30 days, we will notify you and offer a refund option, as required by the FTC’s Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435).  

5. Sizing and Fit

Our shirts are designed to be true to size based on standard U.S. sizing charts, available on the Website. Due to variations in body types or manufacturing tolerances, we cannot guarantee a perfect fit for every individual. No returns or refunds will be issued for sizing issues. Please review our sizing charts carefully before ordering.
